🇸🇰 The Slovak version of these Terms is the binding legal text. This English version is provided for international users and payment provider compliance review. In case of any discrepancy between the Slovak and English versions, the Slovak version prevails.
1. Introductory provisions
1.1. These General Terms of Service (hereinafter the "Terms") govern the rights and obligations of the contracting parties when using the internet service CardMadeEasy.com (hereinafter the "Platform"), operated by:

1.2. The Platform serves as an intermediary for the purchase and sale of collectible trading cards (Trading Card Games, primarily Pokémon TCG, Magic: The Gathering, Yu-Gi-Oh!) between private individuals within the European Union.
1.3. These Terms are binding on all users of the Platform. By creating a user account, you express your consent to these Terms in their entirety.
2. Definitions
2.1. For the purposes of these Terms, the following terms have the following meanings:
a) Platform — the website cardmadeeasy.com and all its components (sub-pages, mobile interface, API);
b) User — a natural person who has created an account on the Platform;
c) Seller — a User who has created at least one Listing for the purpose of selling a collectible card;
d) Buyer — a User who expresses interest in purchasing a card from a Listing;
e) Listing — an offer to sell a specific collectible card published by a Seller on the Platform;
f) Transaction — the process from the Buyer's payment, through delivery confirmation, to the release of funds to the Seller;
g) Escrow — the holding of Transaction funds with a regulated third party (Stripe Connect) until the Buyer confirms receipt;
h) Commission — the Operator's fee for facilitating the Transaction.
3. User account and eligibility
3.1. Use of the Platform is permitted exclusively to natural persons aged 18 or older who use the Platform as private individuals (consumers/non-businesses).
3.2. The Platform is not intended for:
- legal entities (companies, associations, etc.)
- self-employed persons (sole proprietors, freelancers) acting in the course of their business
- minors
3.3. During registration, the User confirms by checkbox their consumer-only status and agrees that should they exceed the volume of "occasional sales" under applicable tax/trade laws (approx. €2,500/year per EU guidance, with the specific threshold determined by the User's country of tax residence), they are obligated to register a sole proprietorship or business and stop using the Platform as a private individual.
3.4. The User is obliged to provide truthful and current information during registration and to keep this information up to date.
3.5. The Operator reserves the right to suspend or close any account that violates these Terms, applicable laws, or that the Operator reasonably believes is operated by a business entity.
4. Listings and seller obligations
4.1. Sellers are responsible for the truthfulness and completeness of all information in their Listings (card name, condition, price, photos, shipping terms).
4.2. Photos in Listings must be actual photos of the specific card being sold (not stock images from card catalogs, unless explicitly marked).
4.3. Prohibited content:
- counterfeit, reproduced, or pirated cards
- cards damaged in a way not disclosed in the Listing
- proxies and unofficial reprints
- cards or content infringing third-party intellectual property rights
4.4. The Seller is obliged to ship a sold card within 5 business days of payment notification.
4.5. Before shipping a Card, the Seller must complete KYC verification through Stripe Connect (identity verification, bank account). Without completed KYC, payouts cannot be processed.
4.6. Sale modes — Fixed price and Auction. When creating a Listing the Seller selects one of two sale modes:
a) Fixed price — buyer purchases instantly by clicking "Buy now" at the listed price.
b) Auction — time-limited bidding. The Seller sets a starting price, minimum bid increment (default €0.50), duration (1 to 30 days) and optionally a "Buy Now" price for immediate purchase outside the bidding flow.
4.7. Auction rules.
a) Any registered Buyer with a verified e-mail may place a bid at or above the current highest bid plus the minimum increment set by the Seller.
b) A bid is a binding offer to enter a contract of sale. Once accepted by the Platform it cannot be withdrawn or modified by the Buyer.
c) Anti-snipe extension: if a valid bid is placed in the last 60 seconds of the auction, the end time is automatically extended by 60 more seconds. Extensions continue until 60 seconds pass without a new bid.
d) End of auction: the Buyer with the highest valid bid at the moment the auction ends becomes the winner. The contract of sale between the Seller and the winner is concluded at that moment.
e) Post-auction reservation: the winner has 48 hours from the end of the auction to pay the purchase price via the Platform (escrow per §5). If no payment is received within this window, the winner forfeits the card and the Operator may re-offer the Listing to the next highest bidder or return it to the Seller.
f) Buy Now (optional): if the Seller set a "Buy Now" price, any Buyer may end the auction immediately by purchasing at that price, provided no bid above the Buy Now price has been placed.
g) The Seller may not bid on their own auction (shill bidding prohibited). Violations may result in Listing cancellation, account suspension and seller-mode lockout.
h) Cancellation by Seller: the Seller may cancel an auction only while no bid has been placed. Once any bid is received the auction is binding and cannot be cancelled (except in exceptional cases approved by the Operator, e.g. provable loss of the item).
4.8. Auction commission. The standard Commission per §6 is calculated from the winning bid (or Buy Now price) the same way as for fixed-price sales.
4.9. Auction notifications. The Platform notifies participants by e-mail and in-app:
a) Seller and winning Buyer when the auction ends;
b) any Buyer who has been outbid;
c) Buyer and Seller 24 hours before the 48-hour reservation deadline expires without payment.
5. Purchase process and escrow protection
5.1. Payments are processed through Stripe Connect (Stripe Payments Europe Ltd., regulated by the Central Bank of Ireland).
5.2. Payment flow:
- The Buyer pays the listed amount + shipping by card.
- Funds are held in a Stripe escrow account in the Operator's name.
- The Seller is notified to ship the package.
- After delivery (or after 30 days from payment, whichever is sooner), the Buyer is asked to confirm receipt.
- After Buyer confirmation, funds (minus Commission) are released to the Seller's Stripe Connect account.
- The Seller can withdraw funds to their bank account according to Stripe's payout schedule (typically 1–7 days).
5.3. If the Buyer does not confirm receipt within 30 days, the Operator may automatically release funds, provided no dispute was opened.
5.4. Shipping via Packeta. All shipments are delivered through Zásilkovna s.r.o. (brand "Packeta", Czech reg. no. 28408306) and its regional subsidiaries (Packeta Slovakia s.r.o., reg. no. 48136999 for Slovakia):
a) Label generation. Once payment lands in escrow, the Operator automatically generates a shipping label via Packeta's REST API. The PDF label is made available to the Seller in the "My Sales" section.
b) Shipping cost. Dynamic pricing based on destination country (SK, CZ, PL, HU, AT) and parcel weight, calculated at checkout. The Buyer pays it together with the listing price in a single Stripe payment. The Operator pays Packeta; after escrow release the Seller receives the net listing price minus Commission (§6) and Stripe fees (§6).
c) Pickup-point delivery. At checkout the Buyer selects a Z-BOX or Packeta pickup branch based on their ZIP code. Door delivery is not supported during Lean Beta.
d) Indicative delivery times:
- Within SK: 1–2 business days
- Cross-border (SK ↔ CZ/PL/HU/AT): 2–4 business days
e) Tracking. Shipment status is shown in "My Purchases" and refreshed every hour via Packeta's packetStatus REST endpoint. The Buyer receives SMS + email notifications from Packeta at handover, depot transit, arrival at the pickup point, and pickup.
f) Physical pickup ≠ content confirmation. Picking up the parcel from a Z-BOX or pickup branch represents only physical receipt under Packeta's terms. It does not confirm that the contents match the listing. The Buyer must open the parcel, inspect the card (authenticity, condition, edition) and only then click "Confirm delivery" in the app. Only this manual action releases the payment to the Seller.
g) Loss or damage in transit. Loss or damage during transport is Packeta's responsibility under its T&Cs. The Operator assists with claims against Packeta and, in cases of proven loss, refunds the Buyer the full escrow amount (including shipping).
6. Commission and fees
6.1. During the Beta phase (until further notice), the Operator's Commission is 0 % for the first 100 Sellers, otherwise 5 % of the sale price (excluding shipping).
6.2. Stripe transaction fees (approx. 1.5% + €0.25 per EU consumer card transaction) are deducted automatically.
6.3. The complete fee breakdown is shown in the Seller's transaction history.
7. Dispute resolution
7.1. If the Buyer does not receive the package or receives a card in a condition not matching the Listing, they may open a dispute in the Platform within 30 days of the expected delivery.
7.2. The Operator acts as mediator in the dispute, examines evidence (photos, tracking, communication), and decides about:
- full refund to the Buyer (with reversal of escrowed funds)
- partial refund
- dismissal of the dispute (funds released to the Seller)
7.3. The decision of the Operator is non-binding for civil-law purposes — either party retains the right to seek judicial remedies under Slovak law.
8. Liability
8.1. The Operator is not a party to the purchase contract between the Buyer and the Seller. The Operator only facilitates the conclusion of the contract and provides escrow protection.
8.2. The Operator does not warrant the authenticity, quality, or condition of cards sold by Sellers — these are warranted by the Seller in accordance with applicable consumer protection laws.
8.3. The Operator's liability is limited to direct damages caused by gross negligence or willful misconduct of the Operator, up to a maximum of the value of the affected Transaction.
9. Intellectual property
9.1. The trademarks "Pokémon", "Magic: The Gathering", "Yu-Gi-Oh!" and others are the property of their respective rights holders. The Platform is not affiliated with, sponsored by, or endorsed by these companies.
9.2. Listings on the Platform constitute the resale of physical cards, which is permitted under the principle of exhaustion of intellectual property rights (Article 4(2) of Directive 2001/29/EC).
10. Account termination
10.1. The User may close their account at any time through the profile settings (right to be forgotten under GDPR Article 17).
10.2. Active escrow transactions must be completed first.
10.3. Sales history (anonymized) and accounting records are retained for 10 years per Slovak tax law (Act 431/2002 Coll.).
11. Final provisions
11.1. These Terms are governed by the law of the Slovak Republic.
11.2. Disputes between the Operator and the User shall be settled by the courts of the Slovak Republic having jurisdiction over the registered seat of the Operator.
11.3. EU consumers retain the right to use the European Online Dispute Resolution platform (https://ec.europa.eu/consumers/odr/).
11.4. Should any provision of these Terms be invalid or unenforceable, the remaining provisions shall remain in full force.
11.5. The Operator reserves the right to change these Terms. Material changes will be announced by email at least 30 days in advance. Continued use of the Platform after the changes become effective constitutes consent.
12. Third-party intellectual property
12.1. Product identification. CardMadeEasy is a secondary marketplace for collectible card games. The catalog displays card names, numbers, sets and editions solely for the purpose of identifying products that sellers have lawfully acquired and are reselling through the platform. This constitutes nominative use of trademarks and identifying information to the extent necessary for the marketplace to function.
12.2. Rights of card publishers. All images, illustrations, series names and logos displayed in the catalog are the intellectual property of the respective publishers:

These companies are not operators of CardMadeEasy and do not sponsor or endorse this platform in any way.
12.3. Card images. Catalog images are loaded directly from publisher sources or publicly available APIs (pokemontcg.io, Scryfall.com, ygoprodeck.com) and serve only as a visual aid for identifying the item for sale. Images are not hosted on CardMadeEasy infrastructure.
12.4. User-uploaded photographs. For individual listings, sellers upload their own photographs of their cards (owned by the seller, licensed to the marketplace for the purpose of displaying the listing). These photographs are not publisher material.
12.5. Notice & takedown. If you are a copyright holder and believe that content on CardMadeEasy infringes your rights, contact us at [email protected] or [email protected]. The notification must include:
- identification of the protected work,
- the exact URL of the disputed item,
- a statement of authority to act on behalf of the rights holder,
- contact details (name, address, email, phone).
We will respond within 48 hours on business days. For justified notifications, we will promptly remove or replace the disputed content.
12.6. Counter-notification. A seller whose listing has been removed following a DMCA / copyright notice has the right to submit a counter-notification. The procedure follows the same steps as the initial notice.
